PAN Inoperative? Everything That Breaks When PAN–Aadhaar Isn’t Linked (and the Fix)

If your PAN isn’t linked to Aadhaar, it is inoperative — legally existing but functionally broken. The damage is quiet: TDS/TCS at double or 20%+ on your salary, FD interest, property deals and dividends; refunds withheld (with no interest for the inoperative period); MF/demat transactions blocked on KYC; banks flagging the account. The fix costs ₹1,000 (late-linking fee) plus the linking request — the PAN typically becomes operative within about 30 days. NRIs and a few categories are exempt, but must get their status updated to avoid the same treatment.

The nasty part is the deductor’s side: employers and banks discover the inoperative status in bulk PAN-verification runs and quietly switch you to 20% TDS. Many people only notice months later — as a shrunken salary credit or an FD interest payout that looks wrong. The excess is adjustable/refundable, but only after linking and filing.

Who is exempt (but read the fine print)

  • Non-residents (NRIs) as per the Act — but only if your NRI status is updated in the PAN database; thousands of NRIs got marked inoperative because the department still had them as residents. Fix: update residential status via the jurisdictional AO/portal with passport evidence.
  • Residents of Assam, Jammu & Kashmir and Meghalaya (Aadhaar-exemption states categories).
  • Individuals aged 80+ and non-citizens.

The fix, step by step

  1. Check status: incometax.gov.in → Quick Links → “Link Aadhaar Status”. Takes 30 seconds.
  2. Pay the ₹1,000 fee via e-Pay Tax (minor head for Aadhaar-linking late fee).
  3. Submit the link request (Quick Links → Link Aadhaar) after the challan reflects — name/DOB mismatches between PAN and Aadhaar must be corrected first (usually on the Aadhaar side, it’s faster).
  4. Wait for operative status — commonly up to ~30 days. Save the acknowledgement.
  5. Afterwards: tell your employer/bank to re-verify your PAN so normal TDS resumes; excess TDS already deducted comes back through the ITR; MF/demat KYC revalidates in the following cycles.

NRI shortcut: don’t pay the ₹1,000 reflexively. If you’re genuinely non-resident, the correct fix is a residential-status update with the AO — linking Aadhaar (which many NRIs don’t hold) isn’t the requirement for you.

FAQs

Is an inoperative PAN the same as a cancelled PAN?

No — it’s suspended-in-effect, not dead. Linking revives the same PAN; you never apply for a new one (holding two PANs is itself penalised).

My employer deducted 20% for three months before I linked. Money gone?

Not gone — it’s TDS credit against your PAN. After linking, it adjusts in your ITR; the true cost is cash-flow and the interest-free wait.

Do minors need to link?

Linking applies where Aadhaar is required to be intimated; a minor’s PAN typically gets linked once Aadhaar exists — do it before their first investment KYC.

Will my old refunds also release after linking?

Yes — held refunds process once the PAN is operative, but without interest for the inoperative stretch. Another reason to fix it this week, not at filing time.
